買家支付所有貨款之後，可到本公司指定地址提貨；本公司亦可為買家安排運送服務，買家須承擔運輸費用 (包括所有包裝、郵寄、運輸及其他相關費用)，但當中所引致的清關、損毀及 / 或遺失等所有問題及風險，L&H Auction將不會承擔。但是，L&H Auction會以買家名義為寄出的拍賣品購買全額保險，當中產生的保險費、運輸費、包裝費及進出口關稅等將由買家支付；部份拍賣品受制於CITES出入口限制，當中一些拍賣品無法提供先前的CITES出入口許可證文件，則本公司只能將該拍品運送至香港境內的地址。
一般銷售說明及條款
以下協議適用於仕宏拍賣有限公司 ( L&H Auction Co., Ltd., 簡稱 "L&H Auction")舉行的所有拍賣會。L&H Auction、拍賣品寄售人及買家均受此協議約束。
1.買家佣金
(只適用於「珍稀相機專場」、「名茶御器專場」及「香道花器專場」)
參與拍賣的買家(現場競投﹑電話競投﹑联拍網上競投﹑電郵及/或傳真的競投者)在拍賣的成交後，須向L&H Auction支付中標價的18%作為買家佣金；拍賣會完結後七個工作天內付清款項可享有以中標價的15%作為買家佣金的優惠；經51BidLive網上競投者則須支付中標價的21%作為買家佣金，拍賣會完結後七個工作天內付清款項可享有以中標價的額外18%作為買家佣金的優惠。
(只適用於「玉器瓷雜專場」及「中國書畫專場」)
參與拍賣的買家(現場競投﹑電話競投﹑联拍網上競投﹑電郵及/或傳真的競投者)在拍賣的成交後，須向L&H Auction支付中標價的15%作為買家佣金；經51BidLive網上競投者則須支付中標價的18%作為買家佣金。
2.保證金(只適用於「玉器瓷雜專場」及「中國書畫專場」)
參與現場競投的買家須在開拍前最少三十分鐘前到登記處交納保證金 (港幣十萬元現金) 。參與電話競投﹑網上競技﹑電郵及/或傳真的買家必須在本拍賣會舉行日期十日之前提交投標委託書，並通過匯款形式交付保證金(港幣十萬元)。申請一經確認，L&H Auction將以書面形式回覆買家。拍賣會舉行日期十日之前若未能確認保證金或委託書，申請將視為無效。
拍賣會當天以現金支付保證金的買家，保證金會於相關拍賣會完結後即埸退還或用來抵結貨款。
3.拍賣品成色及圖錄
所有拍賣品均以其「現況」出售。不可退貨，所有銷售均為一錘定音。拍賣品圖錄中的文字介紹、估價、圖片以及其他形式的影像製品和宣傳品僅供買家參考，並不表明L&H Auction就拍賣品的真實性、價值、色調、質地及瑕疵(如有)等作擔保。L&H Auction可於拍賣前對上述之介紹及評價作出修訂並毋需對其中的不準確或遺漏之處負責。L&H Auction建議買家在拍賣日前親自審看拍賣品，以了解其狀況。買家需對自己競買拍賣品的行為負責。
因印刷或攝影等技術原因造成拍賣品的在圖錄及/或其他任何形式的圖示、影像製品和宣傳品中的色調、顏色、層次、形態等與原物存在誤差者，以原物為準。
4.成色評級說明(只適用於「珍稀相機專場」)
以下拍賣品成色評級只供參考，並非經科學鑑定之評級。而以下成色評級說明只適用於每件拍賣品的整體成色，拍賣品的所有瑕疵並不會在本圖錄中盡錄。
競投者在任何情況下就以上成色評級說明所作的投標決定，L&H Auction將不會負任何責任。
5.預計成交價和保留價
本圖錄中所有預計成交價及 / 或任何價格均以港元 (?$?) 顯示。估價並非指該拍賣品自身應有的市場價值及 / 或最終價格。拍賣品的估價由L&H Auction提供參考，在拍賣會開始前，L&H Auction可對此價格進行調整。
每件拍賣品都設有一個不公開的保留價。
6.預展
L&H Auction會將所有拍賣品於拍賣日前進行公開預展, 買家可在預展當日親自前往查看所有拍賣品。L&H Auction建議買家在預展日親自審判拍賣品的原物及狀況，而不應依賴本圖錄中的說明以及其他形式的影像製品和宣傳品之表述做出決定。買家需對自己競買拍賣品的行為負責。
7.撤回拍賣品
L&H Auction有權在拍賣會開始前，撤回拍賣會上任何一件拍賣品。
8.投標、拒絕和底價
買家應該是出價最高的投標者。 L&H Auction及拍賣官可以拒絕任何被視為出價過低的公開投標並撤回拍賣品。落槌價是淨購買價，並不包括買家佣金及其他附加費用，有關詳情可細閱本條款中第11及第12點。
所有拍賣品在拍賣時都擁有一個非公開的底價。在競標過程中，拍賣官可以拒絕任何溢價過低的競標及叫價過低的競投。
9.通過傳真、電話或電子郵件競標
我們很樂意代表買家進行代理投標。圖錄、申請表及競投委託書等所需文件可從以下網址下載: www.lhauction.com.hk。參與「玉器瓷雜專場」及「中國書畫專場」的委託競投者，需於在本拍賣會舉行日期十日之前以匯款形式交付保證金 (港幣十萬元)。申請一經確認，L&H Auction將以書面形式回覆競投者。拍賣會舉行日期十日之前若未能確認保證金或委託書，參加申請將視為無效。
所有競標將按照拍賣條款及競投者出價，盡可能以最低價格執行。請注意，為買家的利益起見，請所有投標者盡早交回表格。如同時間有兩位或以上的競投者就同一件拍賣品開出相同價格，L&H Auction將以先到先得的原則處理。電話競投者將於拍賣會開始前，由L&H Auction致電競投者; 但本公司不能保證所有電話均可以成功接通，買家須承擔該等風險。所有電子郵件/傳真投標委託表格必須在本拍賣會開始48小時前遞交。如所需資料未能及時收到，L&H Auction不會就未能收到及/或代為出價而承擔任何責任。
10.網上競投
有關網上競投登記及其他相關事宜，可參閱http://www.lhauction.com.hk/tc/buy.php ，或瀏覽LiveAuctioneers及藝狐網站。網上競投者必須提前透過網站進行登記及通過L&H Auction的審批，方可進行網上競投。買家須支付中標價的額外佣金。詳情請參閱一般銷售說明及條款第1點。
11.擁有權和風險
買家須全額繳付應付款項，並由L&H Auction確定款項被接納後，競投者方可獲得該拍賣品的擁有權。同時，有關該拍賣品的風險亦會轉移至買家。
12.付款及賠償條款
買家同意在本拍賣會結束後7天內支付拍賣品的中標價及買家佣金。付款必須為港元，並採用以下任何形式付款：現金、支票、信用卡、EPS、銀行匯票或銀行電匯。接受的信用卡包括VISA、 MASTERCARD、 AE或銀聯。
若以信用卡付款，買家須要支付發票總值的3%作為手續費。買家宜於購買拍賣品前知會有關的信用卡公司，以減少當實際付款時因尋求授權而引起的延誤。若以EPS付款，買家須要支付發票總值的1%作為手續費。
只有付款全部結清之後，拍賣品才會轉移至買家。除非本司與買家另行安排，否則所有支票和其他付款必須在交貨或發貨前兌現及完成。
如果買家未能在60日內支付拍賣品款項， L&H Auction可自行執行以下一種或多種不與法律抵觸的補救措施：
甲、對買家提出訴訟，索取違約賠償，包括訴訟費用和律師費。
乙、撤銷拍賣品的出售權或出售給買家的任何其他拍賣品。
丙、重新拍賣該拍賣品或私下出售，並提出訴訟以追回以下各項差額：
買家所欠的全部金額加上訴訟費和律師費
支付有費用之後的再售淨收益。如有盈餘，這些盈餘將付給貨主。
丁、保存拍賣品，並且只有當買家支付全部款項(包括買家佣金)及所有直接和間接儲存費用後才把拍賣品交付買家。
在買家未能準時付款之後立刻收取18%的年利息。
戊、保留在拍賣會上出售給該買家的其它拍賣品。
13.運輸及提貨

14.有限責任

乙、作為是次拍賣會的拍賣人，L&H Auction純粹代表寄售人的權益行事。L&H Auction會在拍賣會上以買家所出的最高價格出售該拍賣品，而L&H Auction並不會為買家提供任何意見以作競投。如寄售人及/或買家出現違約，L&H Auction概不負責。
丙、 L&H Auction對於此圖錄中的任何遺漏及/或錯誤概不負責。如往後有任何人使用此圖錄中任何資料作其他用途，L&H Auction將不會承擔任何責任。另外，如需使用或更改本圖錄中任何內容，需以書面通知L&H Auction。
15.附帶條款
本拍賣會中的競投者，均知悉並同意以下條款:
甲、 L&H Auction有權在本拍賣會開始前或進行期間，以口頭或書面形式更改競投者通知書及一般銷售說明及條款。
乙、 競投者通知書及一般銷售說明及條款下的所有交易及相關內容，均根據香港特區的法律解釋和管轄。
註解
拍賣會:
於2016年5月29及30日假香港灣仔港灣道一號香港萬麗海景酒店海景廳舉行的拍賣會。
拍賣品:
所有寄售到L&H Auction並於是次拍賣會中拍賣的貨品。每件拍賣品可以是獨立貨品，亦可以是兩件或以上的貨品組合於同一貨品群中。
保留價:
由拍賣會及寄售者為每件拍賣品設定的最低價格。
寄售人:
於是次拍賣會中寄售貨品的人或公司。
買家:
以拍賣官的落槌價購入拍賣品的任何單位、個人或公司。
拍賣官:
在是次拍賣會上代表L&H Auction拍賣貨品者。
TERMS AND CONDITIONS OF SALE
The following provisions constitute the entire agreement between L&H Auction Co., Ltd. (Hereinafter called ?L&H Auction?), the Consignor, and the Buyer, and will govern the sale of property sold at the Auction.
1. BUYER'S COMMISSION
(Only applicable to "Photographica Auction", "Tea Wares Auction" and "Agarwood & Flower Vase Auction")
Floor bidders, telephone bidders, 51BidLive bidders, e-mail and fax bidders will pay L&H Auction a Buyer's Premium of 18% on top of the winning bid price. Payment settled within 7 working days can enjoy special rate of a Buyer's Premium of 15% on top of the winning bid price.
51BidLive bidders will pay a Buyer's Premium of 21% on top of the winning bid price and any other possible handling fees incurred for the service. Payment settled within 7 working days can enjoy special rate of a Buyer's Premium of 18% on top of the winning bid price.
(Only applicable to "Miscellaneous & Jade Auction" and "Ink Paintings Auction")
Floor bidders, telephone bidders, 51BidLive bidders, e-mail and fax bidders will pay L&H Auction a Buyer's Premium of 15% on top of the winning bid price.
51BidLive bidders will pay a Buyer's Premium of 18% on top of the winning bid price and any other possible handling fees incurred for the service.
2. SECURITY DEPOSIT
(Only applicable to "Miscellaneous & Jade Auction" and "Ink Paintings Auction")
Floor bidders must register at least 30 minutes prior to Auction begins and pay a security deposit (HKD100,000 in cash) upon registration.
Telephone bidders, online or absentee bidders must be arranged in advanced. Telephone bid or absentee bid form (principal form) must be submitted 10 days prior to the Auction; and a security deposit (HKD100,000 in cash) is transferred to our company bank account. Written acknowledgement of receipt will be sent once L&H Auction has confirmed. Failure to confirm the deposit or principal form 10 days prior to the auction day, the application will be considered invalid.
3. REFERENCE OF PROPERTY & LOT CONDITION
All items are offered "AS IS". There is no return privilege, and all sales are final. L&H Auction Co., Ltd. (Hereinafter called "L&H Auction") has sought to express a useful general guide to the condition of each Lot. Bidders should note that our descriptions in this catalogue cannot be taken as an absolutely definitive and complete description of any damage or restoration. The absence of defect or restoration reference does not imply that a Lot is free from defects. The description of a Lot and condition of it are given for reference only. The condition of any Lot, and the nature and extent of any damage or restoration have not been confirmed by any examination prior to the Auction. In terms of functionality, common sense should prevail. One should assume that many of the Lots have seen little recent use, and therefore, have not recently been cleaned, lubricated, or adjusted. This means that some Lots, especially older cameras, might have shutter speeds and/or light meters that might require adjustment and that lenses and optical items might require lubrication and/or cleaning.
L&H Auction has taken all reasonable care to describe the condition of the Lots in the catalogue as accurate as possible. The rating of condition and description of a Lot are given by the experts of L&H Auction at their best knowledge. However, they should not be relied on as full description of a Lot's condition. All prospective buyers must rely solely on their own knowledge and inspection before bidding to determine such issues as age, quality, character, physical condition, mechanical and electrical function and rarity.
4. GUIDE TO RATINGS OF CONDITION (Only applicable to "Photographica Auction")
The ratings of condition are personal opinions and are given for general guidance purpose. It only reflects the overall condition of a Lot and some defects may not be described or mentioned in the Lot text.
L&H Auction shall not be liable to any party in any circumstance that they rely on the rating of condition to make any bidding decision.
5. ESTIMATES & RESERVES
All estimates in the catalogue are in Hong Kong Dollars (?$?) and do not include Buyer's Premium. Estimates are prepared well in advance of the Auction sale and are subject to revision. Estimates are not definitive and meant only to represent the range where L&H Auction thinks the hammer price for the Lot is likely to fall; they should not be relied on as an indication of the actual selling price or value of a Lot.
Every item in the auction has a private Reserve Price. Offers under the Reserve Price would not be taken into account.
6. VIEWING
All Lots are available for public viewing prior to the Auction. L&H Auction recommended that all buyers to inspect the condition of each item in person, rather than relying on the catalogue description. Buyers are responsible for their behavior in bidding at the auction.
7. WITHDRAWAL OF LOT
L&H Auction reserve the right to withdraw any item from Auction before sale.
8. BIDS, REJECTION AND RESERVES
The Buyer will be the bidder who makes the highest bid acceptable to the Auctioneer for any Lot (subject to any applicable reserve) to whom the Lot is knocked down by the Auctioneer at the striking of the Auctioneer's hammer. Any dispute regarding the highest acceptable bid will be settled by the Auctioneer at his/her discretion. The hammer price is the net purchase price, excluding the Buyer's Premium and other possible additional charges stipulated in section 11 and section 12 of this Terms and Conditions of Sale.
Each lot has a Private Reserve Price. L&H Auction and the Auctioneer have complete discretion to refuse any opening bid that deem too low and withdraw a Lot from sale. During the course of bidding, the Auctioneer may reject any increment as being too low at his/her sole discretion.
9. BIDDING BY FAX, E-MAIL OR TELEPHONE
L&H Auction is pleased to make commission bids on your behalf. Catalogue, registration form and bidding form(s), as well as additional information in relation to this auction can be downloaded from www.lhauction.com.hk. Filled registration and bidding form(s) must be submitted 10 days prior to the auction day; and a security deposit (HKD 100,000 in cash) is transferred to our company bank account. Written acknowledgement of receipt will be sent once L&H Auction has confirmed. Failure to confirm the deposit or principal form 10 days prior to the auction day, the application will be considered invalid.
Please note that all bids will be executed at the lowest possible price consistent with this Terms and Conditions of Sale. It is in bidder's interest to return your form as soon as possible, if two or more bidders submit identical bid for a Lot, the bid first received takes preference. Telephone bidder will be called by L&H Auction before bidding starts on relevant Lot(s). However, there is no guarantee that telephone connection can be made successfully. Principal form must be received 48 hours prior to the Auction. Such bids are made at your own risk and we shall not be liable for any failure to receive and/or place any bids by post, fax, e-mail or telephone.
10. INTERNET BIDDING
Please visit http://www.lhauction.com.hk/en/buy.php or browse through LiveAuctioneers website for details of how to bid via the internet. Registration must be done before the Auction. Internet bidders need to pay a Buyer's Premium (please refer to Section 1 in Terms & Conditions of Sale). Internet bidders may also need to pay other possible handling fee incurred for the service.
11. POSSESSION, TITLE AND RISK OF LOSS
Buyer will receive possession of the property only when payment has been made in full and all funds have been cleared. Title and risk of loss will pass to the Buyer when the Buyer has taken possession of the property.
12. TERMS OF PAYMENT AND REMEDIES
Buyer agrees to pay the knocked down price of a Lot and Buyer's Premium within seven (7) days of the Auction conducted. Payment must be made in Hong Kong Dollars (?$?) and be made in any one of the following: cash, check, credit card, EPS debit card, bank draft or bank wire transfer.
Please note that there is a 3% surcharge on the total invoice value when payments are made using credit card and 1% surcharge when using EPS debit card. It may be advisable to notify your card issuer of your intended payment in advance to avoid delays caused by us having to seek authority when you come to pay. Purchased property will not be released to the Buyer until payment in full has been made.
In the event Buyer fails to pay for the property within sixty (60) days of the Auction conducted, L&H Auction may in its sole discretion and in addition and without prejudice to any other right or remedy available to it in law or equity, exercise one or more of the following rights and remedies:
A) Bring an action against Buyer seeking damages for breach of contract including court costs and attorney's fees.
B) Rescind the sale of the property or any other lot sold to the Buyer.
C) Resell the property at auction or private sale and bring an action to recover any deficiency between
i. Full amount owed by Buyer plus court costs and attorney's fees and
ii. The net proceeds, after payment of all expenses, received from the resale. If there is a surplus, the surplus will be paid to Consignor.
D) Store the property and release it to Buyer only upon payment of the full purchase price and Buyer's Premium plus all direct and indirect costs of storage.
E) To charge interest at 18% per annum commencing immediately after failing to pay on time.
F) To retain any other Lot(s) sold to the Buyer at Auction.
13. SHIPPING & COLLECTION
When the payment is settled, buyer can collect Lot(s) at the designated address. L&H Auction packs and ships Lot(s) as a courtesy to Buyer, Buyer bears all transportation and shipping cost; L&H Auction does not bear any responsibility or liability for any issue related to customs clearance and any damage or loss during transportation or shipment. However, L&H Auction will buy insurance for all shipments on behalf of the Buyer as agreed in written. Buyer is charged for the direct cost of shipping, customs clearance and insurance plus a modest additional fee for packaging and handling.
14. EXPORT/ TRADE RESTRICTIONS
It is the Buyers sole responsibility to comply with all Hong Kong export and overseas import regulations relating to the shipment and also to obtain any relevant export and/or import license(s). The refusal of any import or export license or any delay in obtaining such license shall not permit the rescission of any sale nor allow and delay in making full payment.
15. LIMITATION OF LIBILITY
A) In any circumstances where L&H Auction's or Consigner's liability to a Buyer shall not exceed the purchase price actually paid.
B) L&H Auction acts solely for and in the interest of Consignors. L&H Auction will sell the Lot at the highest price obtainable at the sale. L&H Auction does not give advice to bidders for their bidding. L&H Auction will have no liability for any breach by either Consignors or Buyers.
C) L&H Auction takes no responsibility for any mistakes, errors or omissions. All information in this catalogue is compiled solely for the Auction; L&H Auction shall not be liable in any circumstance for further use of information provided in this catalogue. Reproduction of all or any part(s) of this catalogue is not allowed without written permission from L&H Auction.
16. TERMS OF ADHESION
By bidding at the Auction, the bidder acknowledges and agrees that:
A) Notice to Bidder and Terms and Conditions of Sale will represent the entire agreement of the parties, provided that the terms may be altered by L&H Auction prior to or at the time of Auction by oral or written announcement or posted notice.
B) All transactions to which the Notice to Bidder and Terms and Conditions of Sale applied and all connected matters will be governed by and in construed in accordance with the laws of Hong Kong SAR.
C) Notice to Bidder and Terms and Conditions of Sale are published in both Chinese and English. If there is any dispute in its interpretation, the English version will prevail.
GLOSSARY
Auction:
The Auction to be held on 29th & 30th May 2016 at Concord Room of Renaissance Harbour View Hotel Hong Kong, 1 Harbour Road, Wan Chai, Hong Kong, China.
Lot(s):
Any item consigned to L&H Auction that to be available to sales at the Auction. A lot can be an individual item or items comprised in a group of two or more items offered for sale as one lot.
Reserved Price:
The minimum price that a Lot may be sold, which is set whether by auction or a private treaty.
Consignor:
A person or a company consigns the Lot(s) to be sold in the Auction.
Buyer:
Any Lot knocked down by the Auctioneer, to the hammer price that a party (a person or a company) purchased at the auction.
Auctioneer:
The person represents L&H Auction conducting the sale in the Auction.
