By bidding in Grandmother’s Treasures Auctions, you agree to be bound by these terms and conditions. Grandmother’s Treasures reserves the right to change the terms of sale and any such changes shall become part of the conditions of sale. FIRST TIME BUYERS First-time buyers are required to submit a copy of their id and a copy of the back and front of their credit card. They are also required to fill out and submit the registration form. FINAL SALE We do not give refunds on any items for any reason! All sales are final! No exceptions. CONDITION AND AUTHENTICITY OF ITEMS All items are sold AS IS and WHERE IS. All of our materials (i.e. Partial Catalogs, Catalogs & Advertisements Digital and Print) are meant merely as a guide. Descriptions and condition reports (verbal and written) are considered knowledgeable opinions and are to be taken for informational value only, and are not to be taken as warranties or guarantees of any kind. In no event shall Grandmother’s Treasures nor its consignors be responsible for the correctness of description, genuineness, attribution, provenance, authenticity, authorship, age, condition, manufacturer, materials, completeness, estimate of value, or any other feature of the items being sold. Please note that all measurements and weights provided by Grandmother’s Treasures descriptions and any other information provided by Grandmother’s Treasures are accurate. BIDDING By placing a bid, you signify that you have examined the item(s) as fully as you have desired to or that you have chosen not to examine it/them. When you place a bid, you enter into a contractually binding and irrevocable obligation to complete the transaction if you are the ‘winning bidder’ of that lot. The 'winning bidder' is the person certified to be the highest bidder by the auctioneer, and it includes any under-bidder who is awarded the lot following the failure for any reason of a higher bid as decreed by the auctioneer. Under no circumstances can a bid be retracted after it has been submitted. The ‘winning bidder’ assumes the full risk and responsibility of the property that he/she has purchased, agrees to sign any forms related to confirmation of purchase, and agrees to pay the full purchase price (the hammer price + the buyer's premium). CONDITION REPORTS The condition of an item is not included in its description. Bidders must request condition reports directly from Grandmother’s Treasures for a particular item or lot number. Condition reports are knowledgeable opinions and are not meant to be warranties and/or guarantees of any kind. Prospective bidders must come to the previews to judge whether or not the condition reports provided by Grandmother’s Treasures are accurate. AUCTIONEER'S RIGHTS The decision of the auctioneer is final and cannot be challenged for any reason. The auctioneer has the right to reject any bid and he/she shall have the sole and final discretion either to determine the successful bidder or to re-offer and resell the article in the case of a dispute. Potential bidders may be turned away at the sole discretion of the auctioneer. The auctioneer may reopen an item if he/she determines an error. PAYMENT Acceptable methods of payment include certified check, money order, credit cards (Visa, MasterCard, American Express, Discover - A 3% merchant fee is added to every credit card transaction) will be accepted for transactions up to $5,000 and wire transfers. Grandmother’s Treasures is not responsible for any fees/charges associated with wire/bank transfers. Grandmother’s Treasures reserves the right to hold items paid by check until the check has cleared. No merchandise will be released until payment has been received in full. TAXES All purchases are subject to Florida sales tax unless the purchaser possesses a current resale certificate. If the purchaser does possess a current resale certificate, he/she must email to Grandmother’s Treasures a copy of his/her resale certificate. International bidders are responsible for all taxes and fees for item(s) shipped outside the US. UNPAID FOR AND/OR UNPICKED UP ITEMS All item(s) shall be paid for by the 'winning bidder' within seven (7) business days of the auction sale. If the item(s) are not paid for within 7 business days, Grandmother’s Treasures reserves the right to do any of the following: cancel the sale, sell the item(s) to another buyer. Grandmother’s Treasures may prohibit delinquent buyers from participating directly or indirectly as a bidder or purchaser in any future sale(s). If the 'winning bidder' has paid for the item(s) but has not picked up his/her item(s) within ten (10) business days, Grandmother’s Treasures will charge a storage fee of $10 per day on each item (unless the 'winning bidder' has contacted Grandmother’s Treasures and Grandmother’s Treasures has agreed to make an exception for the purchaser). Grandmother’s Treasures will not be responsible for any loss, damage, or theft for any paid goods left in the company's possession after ten (10) business days. If the ‘winning bidder’ or purchaser has paid for his/her item(s) in full but has not picked up his/her merchandise within one month (including business and non-business days) of the auction sale, Grandmother’s Treasures has the right to cancel the sale and will NOT refund back the payment to the ‘winning bidder’ or purchaser. SHIPPING/HANDLING/PACKING It is the buyer’s responsibility to arrange and pay for the pickup/shipping/handling/packaging/insurance of purchased item(s). If the buyer chooses to have a third party (i.e. shipper, person other than buyer) pick up his/her purchased item(s), the buyer must send an email to Grandmother’s Treasures, which clearly states that the buyer is authorizing the third party to pick up those item(s). Whether the buyer decides to pick up the purchased item(s) directly from the premises of Grandmother’s Treasures or whether the buyer arranges for a third party (i.e. shipper or person other than the buyer) to pick up the item(s), Grandmother’s Treasures will not be responsible for item(s) that have left its premises. Shippers assume all responsibility for the purchaser’s item(s) that have left the premises of Grandmother’s Treasures. Grandmother’s Treasures may recommend shippers and/or truckers to its buyers but Grandmother’s Treasures is not responsible for the actions of those shippers and/or truckers and Grandmother’s Treasures does not provide warranties or guarantees of any kind for those shippers and/or truckers. Certain item(s) may not be shipped interstate or internationally because of the materials that the item(s) are made up of. It is the buyer’s responsibility to research and be aware of all pertinent laws before bidding on an item. WITHDRAWAL OF ITEM(S) FROM AUCTION Grandmother’s Treasures has the right to withdraw any item at any time for any reason and holds no liability from the removal of this item. BUYER’S PREMIUM A buyer’s premium of 25% will be added to the hammer price of each lot. The buyer’s premium is the same for online bids, phone bids, and absentee bids. RESERVE All items may be subject to a reserve, which is predetermined by the auctioneer and Grandmother’s Treasures prior to bidding. The reserve is the confidential minimum hammer price at which a lot will be sold. Grandmother’s Treasures may reach these reserves by bidding on behalf of the consignor and may bid up to the amount of the reserve by placing consecutive bids for a lot or by placing bids in response to other bidders. The auctioneer has the right to withdraw the item from the sale if the reserve has not been met. LOSS OF INTERNET CONNECTION WHILE AUCTION IS IN PROGRESS In the unlikely event that Grandmother’s Treasures loses its internet connection, it reserves the right to cancel the remainder of the auction.
